Terms of Service

This Terms of Service Agreement ("Agreement") is entered into between Fortify Training ("Gym," "we," "us," or "our") and the individual agreeing to these terms ("Member," "Client," or "you"). By enrolling in classes, personal training, or using our facilities, you agree to the following terms.
1. SERVICES PROVIDED
Fortify Training provides group fitness classes, personal training, open gym access, and related fitness services (collectively, the "Services"). Services may be modified, suspended, or discontinued at any time.
2. ELIGIBILITY
You must be at least 18 years old to participate unless written consent is provided by a parent or legal guardian. By participating, you confirm that you are physically able to engage in fitness activities.
3. HEALTH ACKNOWLEDGMENT & ASSUMPTION OF RISK
You acknowledge that participation in fitness activities involves inherent risks, including but not limited to injury, illness, or death. You voluntarily assume all risks associated with participation.
You confirm that:
You have consulted a physician or determined you are physically fit to participate.
You will immediately stop any activity that causes pain, dizziness, or discomfort.
4. WAIVER & RELEASE OF LIABILITY
To the fullest extent permitted by law, you release and hold harmless Fortify Training, its owners, employees, contractors, and affiliates from any claims, demands, or causes of action arising from participation in the Services, including negligence.
5. MEMBERSHIPS, PACKAGES & PAYMENTS
All fees must be paid in advance unless otherwise stated.
Memberships, class packages, and training sessions are non-refundable and non-transferable unless required by law.
Expiration dates apply to all packages.
Failure to attend scheduled sessions may result in forfeiture.
6. CANCELLATIONS & NO-SHOW POLICY
Class and training cancellations must be made at least 6 hours in advance.
Late cancellations or no-shows may result in loss of session and/or additional fees.
7. PERSONAL TRAINING
Personal training sessions must be scheduled in advance and a 48 hour cancellation/reschedule notice is needed or you lose the session. Trainers may be substituted at our discretion. Programs and results are not guaranteed.
8. FACILITY RULES & CONDUCT
You agree to:
Follow all posted rules and staff instructions.
Use equipment properly.
Treat staff and other members with respect.
We reserve the right to suspend or terminate access for unsafe, disruptive, or inappropriate behavior.
9. EQUIPMENT & PROPERTY
You are responsible for any damage caused by misuse of equipment. Fortify Training is not responsible for lost, stolen, or damaged personal property.
10. INTELLECTUAL PROPERTY
All content, programming, branding, and materials provided by Fortify Training are our intellectual property and may not be reproduced without written consent.
11. MEDIA RELEASE
You grant permission for photographs or videos taken during activities, classes, and personal training to be used for marketing and promotional purposes unless you opt out in writing.
12. TERMINATION
We reserve the right to terminate or suspend your access at any time for violation of these terms or for safety reasons.
13. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Massachusetts.
14. SEVERABILITY
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
15. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between you and Fortify Training and supersedes all prior agreements.
